1. Overview
This website is owned and operated by Loyaltydraw.com Inc. (doing business as "Loyalty Draw"). Throughout the site, references to "we," "us," and "our" refer to Loyalty Draw. We provide access to this website, including all content, tools, and services available herein, subject to your acceptance of the terms, conditions, and notices outlined below.
By visiting our website and/or purchasing from us, you are engaging with our "Service" and agree to be legally bound by these Terms of Service ("Terms"), as well as any supplemental terms and policies linked or referenced herein. These Terms apply to all users of the site, including but not limited to visitors, customers, merchants ("Providers"), and content contributors ("Participants").
Please read these Terms of Service carefully before accessing or using our website. If you access any part of the site, you acknowledge and agree to be bound by these Terms. If you do not agree with all terms and conditions set forth here, you may not access the site or use any portion of our services.
We may introduce new features or tools to the current platform, all of which shall also be subject to these Terms. The most current version of the Terms of Service can always be found on this page. We reserve the right, at our discretion, to update or modify these Terms by posting changes on the site. It is your responsibility to check this page periodically. Continued access or use of the site after such updates constitutes your acceptance of the revised Terms.
Our e-commerce platform is supported by third-party infrastructure and service providers, including services provided by Shopify Inc., Stripe Inc., Tremendous.com, and others, which enables us to offer and process digital transactions, identity verification, and reward fulfillment.
2. User Definitions
Provider: A business or merchant that subscribes to Loyalty Draw's platform to offer rewards, punch cards, or participate in promotional activities.
User (or “Account Holder”): Any person who visits, accesses, or uses the Service.
Participant: An end-user who uses Loyalty Draw, including engaging with Providers through Loyalty Draw (for example by scanning QR codes, entering promotional contests where available, or redeeming rewards) and participating in Loyalty Draw’s Home Edition (for example by joining Home Games, submitting daily check-ins, earning Tokens, and participating in Token Draws where applicable).
Contest Participant (or “Entrant”): A User who meets the eligibility requirements in Section 7 and the Official Rules for a specific promotional contest and submits one or more Entries.
Business Edition: The Loyalty Draw features that allow Participants to interact with Providers, including scanning Provider QR codes and participating in Provider rewards or promotions.
Home Edition: The habit-based features of Loyalty Draw that allow Participants to join Home Games and submit daily check-ins.
Home Game: A habit challenge in Home Edition. Home Games may be played solo or as a squad, with durations, formats, and rules as displayed in the Service.
Monthly Promotional Contest: Loyalty Draw’s monthly promotional contest described in Section 7 and the Official Rules.
Entry: A promotional contest entry into the Monthly Promotional Contest (or other promotional contest, if offered), earned only through the methods described in Section 7 and the Official Rules.
Token: A virtual unit earned through Home Edition participation. Tokens are not money, have no cash value, are not transferable, and do not expire; however, redemption options, eligibility, and reward availability may change over time and may be limited by inventory and geography.
Prize Catalog: A feature of the Service that may allow eligible Users to redeem Tokens for certain rewards, subject to available inventory, geographic availability, per-user limits, and additional terms displayed in the Service. If a reward is unavailable, the Redemption will not be completed and your Token balance will remain unaffected. We may require additional verification for certain Redemptions (for example, where fraud, abuse, security concerns, or compliance requirements are identified).
Redemption: The process of exchanging Tokens for a reward through the Prize Catalog, subject to eligibility checks and availability at the time of redemption.
Catalog Inventory: The available stock of rewards in the Prize Catalog. Inventory may be limited, may vary by country, may change without notice, and may be offered on a first-come, first-served basis.
User Content: Any content, materials, or information submitted, posted, linked, uploaded, transmitted, or otherwise made available through the Service by a Provider or Participant, including (without limitation) business profiles, reward details, images, video links, livestream links, and (when available) uploaded video files. Users retain ownership of their User Content, subject to the licenses granted in these Terms.
Token Draw: A draw associated with certain squad Home Games that may award Tokens and/or other in-app rewards, as displayed in the Service, and is separate from the Monthly Promotional Contest.
3. Online Store Terms
By using this site, you confirm that you are at least thirteen (13) years of age (or the minimum age permitted to use the Service in your jurisdiction). If you are under the age of majority in your jurisdiction, you confirm that you have the consent of a parent or legal guardian to use the Service. Token Redemptions through the Prize Catalog may be available to eligible Users age 13+ as displayed in the Service. Promotional contest prize claiming by Users under the age of majority must be completed by a parent or legal guardian as described in the Official Rules.
You agree not to use our services for any unlawful or unauthorized purpose, and not to violate any applicable laws (including intellectual property laws). Transmission of harmful or malicious code is strictly prohibited. Violating these Terms may result in immediate termination of your access.
4. ACCOUNT RESPONSIBILITY
If you create an account on our platform, you are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You agree to notify us immediately of any unauthorized access or security breach. Loyalty Draw is not responsible for any loss arising from your failure to safeguard your account.
5. General Conditions
We reserve the right to refuse service to anyone, for any reason, at any time, to the extent permitted by law.
You acknowledge that, aside from credit card information, any content you transmit may be transferred across networks and adapted to meet technical requirements. Credit card details are always encrypted during transfer.
You agree not to copy, reproduce, sell, or exploit any portion of the Service without express written permission.
All content on the Loyalty Draw platform - including text, graphics, branding, software code, icons, and features - is the intellectual property of Loyaltydraw.com Inc. or its licensors. You may not reproduce, modify, or distribute any part of the Service without our express written consent.
6. Home Edition Terms
Home Edition is a habit-based feature where Participants join Home Games and submit daily check-ins.
Daily check-ins are self-reported. Each day, per Home Game, a Participant may submit one (1) daily check-in (Platform time, currently America/Toronto time unless otherwise displayed). Daily check-ins have three options: Completed, Minimal, or Skip Day.
Tokens may be awarded through Home Edition participation based on the Home Game’s rules as displayed in the Service. Completed and Minimal may earn Tokens. Skip Day does not earn Tokens.
Active Home Game limits apply. VIP users may have up to ten (10) active Home Games at a time (or such other limit as displayed in the Service). Non-VIP users may have up to one (1) active Home Game at a time (or such other limit as displayed in the Service).
Certain squad Home Games include a Token Draw that is separate from the Monthly Promotional Contest. Token Draw entry mechanics (including how entries are earned and any caps) are displayed in the Service for each eligible squad Home Game.
Token Draw timing, eligibility, prize counts, and winner selection depend on the specific Home Game and are displayed in the Service.
If we determine that you attempted to manipulate Home Edition activity or any draw (including by false reporting, automation, duplicate accounts, or other abuse), we may suspend or terminate your account and void all of your entries into any Loyalty Draw draw or selection process, including Token Draw entries and promotional contest Entries. We do not remove Tokens from your Token Balance solely due to enforcement; however, suspended or banned accounts may lose eligibility to participate in any draw and/or redeem Tokens. Enforcement actions apply prospectively and do not reverse rewards already delivered.
Home Games are optional self-directed challenges and do not provide medical, fitness, financial, legal, mental health, or educational advice. Results vary and are not guaranteed.
7. Promotional Contest Terms
Loyalty Draw may run promotional contests, including a monthly promotional contest, as described in the Official Rules. No purchase is necessary to enter or win, and purchases do not increase your chances of winning.
Participants can earn entries by using the “Get Free Entries” feature on the Loyalty Draw platform when available. Additional entries may be earned through optional platform activities such as scanning QR codes at participating Provider locations, as described in the Official Rules. Tokens are not convertible into Entries, and Tokens do not increase your chances of winning. If you are not eligible to participate in a promotional contest due to your country or region, contest entry features will be disabled and a notice will be displayed in the Service.
Some Providers may require a purchase to access their QR code; however, no purchase is required to enter or win the promotional contest overall.
Promotional contests are open only where permitted by law to legal residents of: Canada (excluding Quebec), United States, United Kingdom, Australia, New Zealand, and Ireland, and any other eligible countries expressly listed in the Official Rules for that specific contest, who are at least thirteen (13) years of age at the time of entry. Users under the age of majority in their jurisdiction may be required to have a parent/legal guardian complete prize claiming on their behalf, as described in the Official Rules.
Winners are responsible for any tax reporting required by law. Loyalty Draw will comply with legal obligations but does not request SINs unless mandated by applicable Canadian law.
Official contest rules are located at loyaltydraw.com/pages/rules, which are incorporated into these Terms. Loyalty Draw may cancel or amend contests at any time.
8. Products and Services
Our offerings (digital tools, physical materials, rewards, subscriptions, and Prize Catalog inventory) may be limited in quantity and geography. We reserve the right to modify pricing and discontinue offerings without notice. Rewards may be fulfilled by Tremendous.com or other third parties and may have additional restrictions.
We make every effort to display product images and colors accurately, but cannot guarantee your device's display reflects them precisely.
9. Billing and Account Information
You agree to provide current, complete, and accurate billing and account information for all transactions.
Loyalty Draw reserves the right to reject or cancel any orders that appear to be fraudulent, submitted in bulk by resellers, or that otherwise violate these Terms.
Changes to your account, subscription, or billing may be communicated via the contact details you provide. You are responsible for keeping your contact information up to date.
10. Provider Payment Terms
Providers initially purchase a fixed-duration plan (3, 6, or 12 months). These initial programs do not auto-renew.
To continue using the Service, Providers must manually purchase a recurring subscription plan (3, 6, or 12 months), which does auto-renew unless canceled in advance through the Provider dashboard, to the extent permitted by applicable law. Unless otherwise displayed in the Provider dashboard, cancellations take effect at the end of the then-current paid term and the Provider will retain access through the end of that paid term. To avoid renewal charges, Providers must cancel before the next billing date as displayed in the Provider dashboard.
If a Provider is removed from the platform due to policy violations, fraud, material or repeated customer complaints (after review), or failure to honor their promotions, no refund will be issued for any unused time or services.
11. Provider Responsibilities
Providers agree to:
- Fulfill any rewards or promotions they publish through Loyalty Draw;
- Treat Participants fairly and consistently;
- Not require purchases that violate contest laws;
- Accurately maintain their business profile and reward details;
- Promptly inform us of any issues that may impact the user experience;
- Ensure any Provider-posted media or links (including video links, livestream links, and other Provider-generated content) are accurate, lawful, and do not infringe third-party rights.
Failure to uphold these responsibilities may result in removal from the platform without refund.
12. Optional Tools and Integrations
We may provide access to third-party tools or integrations "as is" without warranties or guarantees of performance. These may include plug-ins, automation tools, embedded services provided by other companies, and reward fulfillment services.
Use of these tools is entirely at your own risk and is subject to the terms and policies of those third parties.
13. Digital Wallet Compatibility
Loyalty Draw provides mobile wallet passes that may be compatible with Apple Wallet and Google Wallet. Availability and functionality may vary depending on device, region, and operating system.
We make no guarantees of platform compatibility and are not responsible for any issues that may arise from third-party wallet systems.
14. Third-Party Content and Disclaimers
Our site may link to or embed third-party content, services, or websites for convenience. We do not control or endorse these third parties and are not responsible for their content, policies, or practices.
Provider-generated content (including Provider-posted videos, livestream links, and other Provider materials) is the responsibility of the Provider. Loyalty Draw does not endorse Provider-generated content and is not responsible for it.
Mentions of companies such as Google, Visa, or Mastercard do not imply affiliation or endorsement unless explicitly stated.
You are responsible for reviewing third-party terms before engaging with their services.
15. User Content and Feedback
Feedback: By submitting feedback or suggestions to Loyalty Draw, you grant us a royalty-free, worldwide, perpetual license to use and distribute it in any medium.
User Content: You retain ownership of your User Content. By posting, linking, uploading, or otherwise making User Content available through the Service, you grant Loyalty Draw a worldwide, royalty-free license to host, store, reproduce, display, perform, distribute, and create technical adaptations of your User Content solely for the purposes of operating, providing, maintaining, marketing, and improving the Service, and as otherwise permitted by law.
You are responsible for ensuring your submissions do not violate any third-party rights or contain unlawful material.
If you believe content on our site infringes your rights, contact hi@loyaltydraw.com with a detailed description and proof of ownership.
16. Personal Information
Your submission of personal information is governed by our Privacy Policy, located at loyaltydraw.com/pages/privacy, which is incorporated into these Terms by reference.
17. Communications Consent
By using Loyalty Draw, you consent to receive communications from us, including account notices, updates, and promotional offers, to the extent permitted by applicable law.
You can unsubscribe or adjust preferences at any time via your account or through opt-out links in our messages. Transactional or service-related messages (e.g., security notices, receipts) may still be sent as permitted by law.
18. Data Storage and Transfer
Your data may be stored or processed in Canada or other jurisdictions where our service providers operate. We take reasonable steps to protect your data and comply with Canadian privacy laws and other applicable privacy laws depending on your location.
Use of the platform constitutes consent to such data transfers.
19. Rewards Misuse and Fraud
We reserve the right to investigate any abuse or misuse of Loyalty Draw, including fraudulent scans, duplicate accounts, false Home Edition check-ins, automation, attempts to manipulate contest entries or Token Draw entries, or abuse of Token Redemptions (including chargeback fraud, repeated redemption disputes, or attempts to exploit inventory limits).
Violations may result in disqualification, reward revocation, account suspension, or permanent ban without refund.
20. Errors, Inaccuracies, and Omissions
We reserve the right to correct any errors or inaccuracies and to update information without notice, including after an order is submitted.
21. Prohibited Users
You may not use the site or services to:
- Violate laws or rights of others;
- Harass or exploit individuals or businesses;
- Upload malware or conduct unauthorized access;
- Scrape, spam, or harvest data from the platform;
- Copy, tamper with, alter, spoof, or misrepresent Loyalty Draw QR codes in anyway. QR codes may only be used as issued through official channels and may not be redistributed or linked to unauthorized services.
22. Disclaimer of Warranties
All services are provided "as is" without warranties of any kind. We disclaim all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement.
23. Limitation of Liability
Loyalty Draw is not liable for indirect or consequential damages, including lost profits or data.
Where such limitations are not allowed, our liability is capped as follows (in the aggregate for all claims in the prior 12 months):
- for Providers: the amount paid by the Provider to Loyalty Draw in the prior 12 months;
- for Users who paid Loyalty Draw for any subscription or Service in the prior 12 months (excluding Provider payments): the amount paid by that User to Loyalty Draw in the prior 12 months; and
- for Users who did not pay Loyalty Draw in the prior 12 months: CAD $100 (or the local equivalent), unless a higher cap is required by applicable law.
24. Taxes and Legal Responsibility
You are solely responsible for any tax obligations that arise from your use of Loyalty Draw, including any contest winnings or revenue as a Provider.
We do not provide tax advice or issue tax forms unless legally required.
25. Force Majeure
We are not liable for delays or failures due to events beyond our control, such as natural disasters, pandemics, internet outages, regulatory changes, or labor disputes.
26. Indemnification
You agree to indemnify Loyalty Draw and its affiliates against any third-party claims resulting from your use of the platform or your violation of these Terms, to the extent permitted by law.
27. Severability
If any part of these Terms is found unenforceable, the rest will remain valid and enforceable.
28. Termination
These Terms may be terminated by you or by us at any time. Upon termination, relevant provisions (including those related to liability, dispute resolution, and account conduct) will continue to apply.
Provider cancellations: Unless otherwise displayed in the Provider dashboard or required by law, Provider cancellations take effect at the end of the then-current paid term. Access remains available through the end of that paid term. No prorated refunds are provided unless required by law.
Termination for cause: We may suspend or terminate access immediately for suspected fraud, abuse, policy violations, or unlawful activity. In such cases, access may end immediately and Tokens may become non-redeemable.
Effect on Tokens and Redemptions: Upon suspension or termination, we may disable Token Redemptions and participation in draws. Tokens do not have cash value and are not refundable.
Effect on User Content: We may remove or disable access to User Content where we reasonably believe it violates these Terms, third-party rights, or applicable law. We may also retain certain records as required for legal, security, or operational purposes.
29. Governing Law and Disputes
These Terms are governed by the laws of Ontario, Canada. Any disputes shall first attempt resolution by contacting hi@loyaltydraw.com. If unresolved, disputes will be handled by the courts in Toronto, Ontario.
30. Changes to Terms
We may update these Terms at any time. Continued use of the site after changes are posted constitutes acceptance of the revised Terms.
We also reserve the right to modify, suspend, or discontinue any part of the platform or its features at our sole discretion, with or without notice. This includes changes to features, availability, pricing, or functionality.
